Terms of Service

These Terms of Service (“Terms”) govern your access to and use of circleofsuccess.com, our partner application, booking tools and related online materials (the “Site”), and describe how our webinar sales machine services work at a high level. By using the Site you agree to these Terms and our Privacy Policy.

1. Who we are

Circle of Success builds, launches and helps run automated webinar businesses around a partner’s expertise: pages, webinar deck, nightly automated webinar, email and text follow-up, paid ads, a sales team for premium offers, buyer financing options and a live dashboard. Tagline: We build the machine. You watch it sell.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site or apply to partner. If you use the Site on behalf of a company, you represent that you have authority to bind that company.

3. Using the Site

We grant you a limited, non-exclusive, non-transferable license to access and use the Site for lawful, personal or internal business purposes. You may not:

• Copy, scrape, reverse engineer or exploit the Site or its content except as allowed by law.
• Interfere with security, rate limits or other users’ access.
• Upload malware, spam or unlawful content.
• Misrepresent your identity or affiliation when applying or contacting us.
• Use the Site to build a competing product by systematically harvesting our materials.

We may suspend or terminate access for violations or to protect the Site and our users.

4. Applications and calls

Submitting an application or booking a call does not guarantee acceptance as a partner. We may accept or decline any application at our discretion. Information you provide must be accurate. Scheduling tools may be operated by third parties (for example booking providers); their terms also apply to that booking experience.

5. Services overview

Typical partner engagements include building and running a webinar sales machine. Scope, timelines, fees, the 50/50 net-profit split (where applicable), refund windows and performance reviews are set in your partner agreement. Public site copy (including “7 to 14 days,” guarantees and examples) is descriptive marketing, not a customized promise until confirmed in writing.

6. Payments

Fees for setup or other services are charged as described in your agreement or checkout. Third-party processors handle card and bank payments. Taxes may apply. Except where a written refund policy says otherwise (including any stated 48-hour refund window), fees are non-refundable once work has progressed beyond the stated window.

7. SMS / Text Messaging Terms

Circle Of Success Marketing LLC (“Circle Of Success”) operates the Circle Of Success SMS alerts program. If you opt in to text messages (for example by ticking the optional, unchecked SMS consent box in your dashboard Notifications settings or on a registration form; see circleofsuccess.com/sms-alerts):

• What you receive. Account alerts such as sale, refund and deposit notifications, webinar registration alerts, verification codes, appointment confirmations and reminders, and support replies. We do not send marketing texts under this program without separate consent.
• Frequency. Message frequency varies based on your account activity (up to 20 msgs/day).
• Cost. Message and data rates may apply. Consent to receive texts is not a condition of any purchase.
• Opt out. Reply STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT) to any message to cancel. You will receive one confirmation text and no further messages. You can also turn SMS off in your dashboard Notifications settings.
• Help. Reply HELP for help, or email support@circleofsuccess.com.
• Carriers. Carriers are not liable for delayed or undelivered messages. Supported carriers include major U.S. wireless carriers.
• Eligibility. You must be 18+ and the account holder or authorized user of the mobile number. We comply with applicable TCPA and CTIA guidelines.
• Privacy. Mobile information is not shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.

8. Workspace chat and user content

Signed-in partners and team members can message each other in the Circle of Success Workspace, on the dashboard and in the COS - Circle of Success app. By using it you agree to these rules:

• Zero tolerance. Do not post objectionable content: harassment, threats, hate speech, sexual content, spam, scams, or anything unlawful or abusive. There is no tolerance for objectionable content or abusive users.
• Report and block. Every message has a Report button that alerts our team, and you can block any user so you no longer see their messages. You can unblock them from their profile.
• Our response. We review reports within 24 hours, remove content that breaks these rules, and suspend or remove the users who posted it.
• Contact. You can also report a problem through our contact page.

9. Intellectual property

The Site, branding, designs, software, copy and other materials are owned by Circle of Success or our licensors and protected by intellectual-property laws. Except for a single personal copy of a page for non-commercial reference, you may not reproduce or distribute Site materials without our written permission.

Content you submit (application answers, testimonials, feedback) remains yours, but you grant us a worldwide, royalty-free license to use it to operate and improve our services and, for testimonials you approve, for marketing.

Partner deliverables (pages, decks, automations) are governed by your partner agreement.

10. Third-party services

The Site may link to third parties (payment, financing, scheduling, social, ads). We do not control those services and are not responsible for their content, terms or privacy practices. Financing approval and terms are set solely by each financing provider.

11. Results and no guarantees

Results vary. Client examples on the Site are not typical and not guarantees. Your results depend on your offer, audience, effort, market and execution. See our Disclosure.

12. Disclaimers

THE SITE AND PUBLIC MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CIRCLE OF SUCCESS AND ITS OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US FOR SITE ACCESS IN THE THREE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER. Partner service liability is governed by your partner agreement.

14. Indemnity

You agree to indemnify and hold harmless Circle of Success and its people from claims, damages, losses and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your content, or your breach of these Terms.

15. Changes

We may update these Terms by posting a new version on the Site. The “Last updated” date will change. Continued use after changes means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules, unless your partner agreement specifies otherwise. Courts located in Florida will have exclusive jurisdiction over Site-related disputes, subject to applicable law.
